§ 94-128. Principal uses permitted subject to special conditions.

  • The following special condition uses shall be permitted in a multiple-family residential district, subject to the conditions required in this section for each use, subject to any and all reasonable conditions which may be imposed in accordance with section 4c(2) of the City-Village Zoning Act, as amended, and further subject to the review and approval by the planning commission and village council as specified in section 94-388, review and approval of conditional uses, and section 94-386, site plan review, of this chapter.

    (1)

    All special condition uses in the one-family residential districts as permitted and regulated under section 94-68.

    (2)

    Convalescent or nursing homes when the following conditions are met:

    a.

    The building shall not exceed a building height of two stories.

    b.

    The minimum lot size shall be three acres.

    c.

    No building shall be closer than 40 feet to any property line.

    d.

    Principal vehicular access to the site shall be in accordance with the provisions of section 94-347, access to a major thoroughfare or collector street.

    e.

    There shall be provided on the site not less than 1,500 square feet of open space for each bed in the home. The 1,500 square feet of land area shall provide for landscape setting, off-street parking, service drives, loading space, yard requirement and accessory uses, but shall not include the area covered by main or accessory buildings.

    (3)

    Accessory buildings and uses customarily incident to any of the above permitted uses.
