§ 42-296. Dredging, filling and dumping.

  • Dredging and filling and/or dumping or backfilling with any material in any manner is prohibited unless, through compensating excavation and shaping of the floodplain, the flow and impoundment capacity of the floodplain will be maintained or improved, and unless all applicable state regulations are met, including but not limited to approvals pursuant to Act No. 245 of the Public Acts of Michigan of 1929 (MCL 323.1 et seq.), as amended; Act No. 167 of the Public Acts of Michigan of 1968 (MCL 323.2a et seq.), as amended; Act No. 347 of the Public Acts of Michigan of 1972 (MCL 281.951 et seq.), as amended; and Act No. 203 of the Public Acts of Michigan of 1979 (MCL 281.701 et seq.), as amended.
